DuPage County State’s Attorney Joe Birkett will be hosting a press conference TODAY, November 29 at 5:00 p.m. to announce the findings of the Grand Jury investigation regarding the murder of Jeanine Nicarico.
Further details will be discussed at the press conference.

Good job, Joe...it only took what 22 years? Rolando Cruz, who came thisclose to being executed, must be breathing a bit easier.
The case againt Cruz was dismissed in November of 1995. Birkett took office in October 1996. Can't you Birkett haters do math?
Oh yeah Brick had nothing to do with the case --- just threaten witnesses.

I don't think they had DNA testing back then.
Um, 5:14 - Birkett was a First Assistant State's Atty, who, along with a Detective, allegedly coerced testimony against Cruz.
there is nothing new with this evidence, indictment should have been done years ago , unfortunately it is a well timed press conference for his eminence.maybe he will admit that they wrongfully convicted the wrong guys -for the first time
Birkett was NOT First Assistant to either Michael Fitzsimmons or Jim Ryan, the two State's Attorneys who tried those cases. Check your facts.
He also wasn't First Assistant to Richie Daley, who screwed up all of the other death penalty cases but somehow avoids the scrutiny of the Chicago Tribune and you, their loyal lapdogs.
One other thing, what was the hurry with the indictment, the guy is serving a life term and there is a "moratorium" on the death penalty?
I suppose the press conference might have been scheduled sometime earlier in the day, had States Attorney Birkett had as his event scheduler 32-year-old Jeanine Nicarico, but then there wouldn't have been any need for a press conference (as no crime would have been committed).
The only reason why this case has dragged on as long as it has is the desire of Birkett to execute Brian Dugan, who is already serving consecutive life sentences for other murders. While I am not opposed to the death penalty, I feel it should be used as infrequently as possible, lest it cheapen the severity of the crimes involved.
Has anyone estimated how much in terms of taxpayer dollars (particularly in tax-hating DuPage County) this drive to stick a needle full of poison in Dugan's arm will cost?
You're right 5:56 - he was chief of the major crimes unit...not exactly freeing him of his culpibility.

and we know the office had what1 million muder cases and say 10,000 employees so the Brick was tooooooo busy with all the other srious crimes to get involved in this case.
Give us all a break, Brick was up to his eyeballs in the effort fry Cruz not once, but three times.
There was little else to do in this relatively small office back in the mid 80's.
Hell, besides giving out get out of jail free cards to donors and looking the other way when county contributors get fat contracts and sweet zoing deals there is still little to do.

I am pretty sure Birkett was not in any of position of influence during the first two rounds of trials. He did not handle one tiny bit of the third trial. Check the transcripts and the newspaper articles as I have.
As for get-out-of-jail free cards, you should report any actual incidence of that kind of conduct to the ARDC immediately or shut up.
I am not sure what 10:28 is talking about, but DuPage has a far cleaner justice system than ANY other county in this state.
They exist under the constant scrutiny of angry liberal newspaper types who choose to reside there because the County of Cook is just plain dirty and dangerous.
DuPage enjoys a crime rate far below any other county of comparable size (irrespective of of economic conditions) in the country. That is because the electorate refuses to tolerate crime the way other jurisdictions do. Birkett gets reelected by overwhelming margins because he does a GREAT job. Lisa Madigan sent crews of people out to DuPage to scan criminal prosecutions over a period of months and all they could come up with was one single plea deal gone awry. (The burned lady agreed to the 43-day sentence when it was paired with a divorce settlement and only got irate when the divorce judge said they could not be linked. That's a fact you can verify.)
If it were otherwise, as I know many of you liberal Birkett-haters will insist, why doesn't anyone run against him?
Cook County is the largest unified court system in the country and even with 600-700 prosecutors and a hundred plus judges, they are overworked and they cannot keep up. It's not their fault. Cook cops and ASA's work their butts off, but the citizens there elect judges and municipal officials that kowtow to whiners and liberal social engineers. Don't believe me? Go observe the proceedings in a felony courtroom in Cook and then go sit in one in DuPage. The difference is startling.
Jeer all you want, but remember what you say on this blog the next time you try to report a property crime or battery in Cook County. That's why I moved to DuPage.
